Art. 6 I lit. a EU GDPR acts as PANT LEGAL’s legal basis for processing operations for which we obtain consent for a specific processing purpose. If PANT LEGAL is subject to a legal obligation which requires the processing of personal data, for example to fulfil tax obligations, the legal basis is Art. 6 I lit. c EU GDPR. This would be the case if, for example, a visitor were injured in our office and his name, age, health insurance data or other vital information had to be passed on to a doctor, hospital or other third parties. The legal basis for such processing would then be Art. 6 I lit. d EU GDPR. Ultimately, the legal basis for processing operations could be Art. 6 I lit. f EU GDPR. If the processing is necessary to safeguard a legitimate interest of PANT LEGAL or a third party, and that legitimate interest is not outweighed by the interests, fundamental rights and freedoms of the data subject, the legal basis will be Art. 6 (1) f EU GDPR. In particular, we are permitted to carry out such processing operations because they have been specifically mentioned by European legislators. The legislators have taken the view that a legitimate interest could be assumed if the data subject is a client of the controller (recital 47, second sentence, EU GDPR).
The criterion for the duration of the storage of personal data is the respective legal retention period. After the expiry of this period, the corresponding data will be routinely deleted, provided that it is no longer necessary for the fulfilment or initiation of the contract.
