Compliance is the term used to denote due and proper observance of laws and internal guidelines by management and employees. National and international criminal prosecutors and antitrust authorities expect that every company has a functioning organization to assist with early recognition and prevention of compliance violations. Failure to institute appropriate measures can, in cases of serious business related compliance violations (e.g. corruption, mobbing, cartel agreements), lead to severe penalties or fines for management and the company which can turn out to be significantly higher than similar offenses committed by a company with a functioning Compliance Management System (CMS).
